Decree 336/2025/ND-CP governs administrative penalties for road traffic activities, effective from March 1, 2026. For the first time, self-drive car rental is specifically addressed in a dedicated legal provision. Direct impacts on renters:
- Mandatory written contract: All rental transactions must be documented in a written contract. Verbal agreements or incomplete paperwork result in fines of VND 8–10 million (individuals) or VND 16–20 million (organizations) for the rental company
- Driving license must have remaining demerit points: ITF is required to check license demerit points (see Q4). If a license has zero points, ITF must refuse to deliver the vehicle
- No driver-accompanied service: The law prohibits providing a driver under a self-drive rental contract
- Clearer liability for automated fines: The rental contract serves as legal basis for determining who was driving when an automated fine is issued
-
Effective January 1, 2025, each driving license is assigned 12 points for managing traffic violations. Each penalty (automated or on-the-spot) may deduct 2–10 points depending on the severity of the violation.
- Zero points → driving is prohibited, must wait at least 6 months then pass a legal knowledge test to restore points
- No violations for 12 consecutive months → points automatically restored to 12

No. A license with zero demerit points means the holder has lost the right to drive, even if the physical card has not expired. This is a new regulation that many people misunderstand.
Under Decree 336/2025, if ITF rents a vehicle to someone whose license has zero points, ITF faces fines of VND 28–30 million (individuals) or VND 56–60 million (organizations). Therefore, ITF is required to verify license points and has the right to refuse vehicle delivery in such cases.
